New obligations for landlords, many landlords assumed that the old rules under The Regulatory Reform (Fire Safety Order) did not apply to them. However, most landlords will now be expected to comply and obtain a professional fire risk assessment.
This news for landlords is not actually as bad as it sounds. The government are aware that they are limited professionals who can do this work and have set up a scheme themselves to prioritise the most urgent cases.
Therefore landlords should complete the online Fire Risk Assessment Prioritisation Tool here
If you follow the guidance and keep a record of your result under the prioritisation tool, then this can be used as a defence (if it shows you do not need to get an assessment immediately) during legal proceedings for breach of duty.
However, this is unlikely to help you if its clear that your property is not fire safe and a serious fire occurs. Even more so if fatalities occur. Also considering that fire is a hazard also under the Housing Health and Safety Rating System.
Therefore we would suggest that all landlords highly consider fire safety and do what they can to protect their tenants and the property.
